Public offer (agreement) for the provision of digital services
This document is a public offer by [Sole proprietor / LLC — enter name] (the "Provider") to enter into an agreement for access to the digital services of the BLOOM platform (mda.in.ua) in accordance with Articles 633, 641 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce".
1. Acceptance of the offer
Registering an account on the Platform and/or paying for a subscription constitutes full and unconditional acceptance of these Terms. A person who has accepted these Terms acquires the status of a User.
2. Subject of the agreement
The Provider grants the User access to BLOOM platform features: a quest system for children, an educational children's wallet, a development profile, AI recommendations and other services in accordance with the selected pricing plan.
3. Registration and children's accounts
- 3.1. Only persons who have reached the age of 18 may register.
- 3.2. Children's accounts are created and controlled by parents (legal guardians), who are responsible for the child's actions on the Platform.
- 3.3. The User is obliged to provide accurate data and not to share account access with third parties.
4. Pricing and payment
- 4.1. Current prices are published on the "Pricing" page. Prices are stated in hryvnia (₴), taxes included.
- 4.2. Payment is made by bank card via a licensed payment provider. Funds are charged in advance for the selected period.
- 4.3. The subscription renews automatically until the User cancels it in the settings. Cancellation stops future charges; the current paid period remains active until it ends.
- 4.4. Refunds are governed by the Refund Policy.
5. Bloom Wallet (educational wallet)
Bloom Wallet is an educational tool for tracking and motivation. Internal points/coins are not electronic money or a means of payment within the meaning of Ukrainian law, cannot be exchanged for cash through the Platform, and are used solely for educational purposes within the family.
6. Rights and obligations of the parties
- 6.1. The Provider undertakes to keep the service operational 24/7, except for scheduled maintenance.
- 6.2. It is prohibited to: use the Platform for unlawful activity, upload offensive content, interfere with the service's operation, or create fake accounts.
- 6.3. The Provider may suspend an account for violating these Terms, with notice to the User.
7. Intellectual property
All elements of the Platform (code, design, texts, graphics, trademarks) belong to the Provider or are used on lawful grounds. Copying without written consent is prohibited.
8. Liability
The Platform is provided "as is". The Provider is not liable for indirect damages, and total liability is limited to the amount paid by the User over the last 12 months. This does not limit consumer rights established by law.
9. Term and termination
The agreement is effective from the moment of acceptance until the account is deleted. The User may terminate the agreement at any time by deleting the account; the Provider may do so in the cases provided for in clause 6.3.
10. Dispute resolution
Disputes are resolved through negotiations. If no agreement is reached, they are resolved in court under the laws of Ukraine. A pre-trial claim is reviewed within 20 days.
